Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of TapNow India products, websites, software, applications, and services.

By purchasing, accessing, registering for, or using any TapNow India service, you agree to these Terms.

1. Our Products

These Terms apply to the following TapNow India products:

1. AI Reviews + Auto Reply & GMB Automation

2. Single Page Website Builder with AI Content

3. Restaurant QR Menu & Order Management

4. Digital V-Card Maker & NFC

5. Loyalty Program & Reward System

Individual products may also have additional product-specific conditions.

2. Account Registration

Where an account is required, you agree to:

• Provide accurate information

• Keep account information updated

• Protect your login credentials

• Prevent unauthorized access

• Notify TapNow India of suspected unauthorized access

You are responsible for activity performed through your account unless caused by a proven security failure attributable to TapNow India.

3. AI Reviews, Auto Reply & GMB Automation

TapNow India may provide tools for review monitoring, AI-assisted response generation, automation, and Google Business Profile-related management.

Use of these features may require authorization or integration with third-party platforms.

TapNow India does not guarantee:

• Google ranking improvements

• A particular number of reviews

• Positive reviews

• Removal of negative reviews

• Permanent Google Business Profile visibility

• Continued availability of third-party APIs or integrations

Users are responsible for ensuring that review responses and business information comply with applicable laws and third-party platform policies.

4. Single Page Website Builder with AI Content

TapNow India may provide tools for creating websites and AI-generated content.

The customer is responsible for:

• Accuracy of business information

• Copyright and ownership rights of uploaded materials

• Images, logos, trademarks, and other content

• Legal compliance of published information

• Claims made on the website

• Required licenses, disclosures, and policies

TapNow India does not guarantee search-engine ranking, traffic, leads, sales, or conversion results.

Website hosting, domain registration, SSL, storage, bandwidth, or other features may be subject to the plan purchased by the customer.

5. Restaurant QR Menu & Order Management

The restaurant/business remains responsible for:

• Menu accuracy

• Food descriptions

• Prices

• Taxes and charges

• Availability

• Order acceptance

• Food preparation

• Customer service

• Refunds relating to food orders

• Compliance with applicable food and business regulations

TapNow India provides technology infrastructure and related software services and does not act as the restaurant, food seller, or delivery provider unless expressly stated otherwise.

6. Digital V-Card & NFC

Digital V-Card and NFC services allow users to publish and share business or professional information.

Users are responsible for ensuring that:

• Information is accurate

• They have permission to publish uploaded information

• Their content does not violate third-party rights

• NFC cards/tags are used lawfully

TapNow India is not responsible for information independently entered or shared by users.

Physical NFC products may be subject to availability, delivery, manufacturing, and replacement conditions.

7. Loyalty Program & Reward System

TapNow India may provide digital loyalty cards, stamps, points, rewards, coupons, or similar features.

The participating business is responsible for defining:

• Reward eligibility

• Number of stamps/points

• Reward conditions

• Expiry dates

• Redemption rules

• Eligible products/services

TapNow India does not guarantee customer participation, sales growth, or redemption rates.

The business must honor valid rewards according to the conditions displayed to customers, except where legally permitted otherwise.

8. Fees and Payments

Product prices, subscriptions, setup fees, renewal fees, taxes, and other charges will be communicated through the applicable order, quotation, invoice, subscription plan, or purchase process.

Unless specifically stated otherwise:

• Taxes may be charged as applicable.

• Subscription services may require renewal payments.

• Third-party charges may apply separately.

• Non-payment may result in suspension or termination of services.

9. Service Availability

TapNow India aims to maintain reliable service but does not guarantee uninterrupted or error-free operation.

Services may temporarily become unavailable due to:

• Maintenance

• Technical failures

• Internet or network problems

• Hosting issues

• Third-party platform outages

• API changes

• Security incidents

• Events beyond our reasonable control

10. Third-Party Platforms

Some features depend on third-party platforms, including Google and payment, hosting, communication, or analytics providers.

TapNow India cannot guarantee continued availability of third-party services, integrations, APIs, policies, features, or functionality.

Changes made by third-party providers may require modifications to TapNow India services.

11. Prohibited Use

Users must not use TapNow India services to:

• Commit fraud or unlawful activities

• Impersonate another person or business

• Upload malicious software

• Violate intellectual-property rights

• Publish unlawful, defamatory, misleading, or abusive content

• Manipulate reviews through prohibited practices

• Attempt unauthorized access to systems

• Circumvent security controls

• Abuse automated systems or APIs

TapNow India may suspend or terminate accounts involved in prohibited activities.

12. Intellectual Property

TapNow India and its licensors retain ownership of the software, platform technology, designs, trademarks, systems, code, documentation, and proprietary materials provided by TapNow India.

Customers retain ownership of content they lawfully own and upload to the platform, subject to the licenses necessary for TapNow India to provide the services.

13. User-Generated Content

By submitting content to TapNow India, you represent that you have the necessary rights and permissions to use and publish that content.

You grant TapNow India the limited rights necessary to host, process, display, transmit, and otherwise use the content solely to provide the requested services.

14. Suspension and Termination

TapNow India may suspend or terminate services where:

• Fees remain unpaid

• The account violates these Terms

• The service is used unlawfully

• Security or platform integrity is threatened

• Required third-party access is revoked

• Continuation of the service becomes technically or legally impractical

Where reasonably possible, TapNow India may provide notice before suspension or termination.

15. Disclaimer

TapNow India provides technology services and does not guarantee specific business results, including:

• Increased revenue

• Increased reviews

• Improved Google ranking

• Increased website traffic

• Increased customer visits

• Increased restaurant orders

• Increased loyalty participation

Business outcomes depend on numerous factors outside TapNow India's control.

16. Limitation of Liability

To the maximum extent permitted by applicable law, TapNow India shall not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from use of the services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold TapNow India harmless from claims, losses, liabilities, or expenses arising from:

• User-provided content

• Unlawful use of the services

• Violation of these Terms

• Infringement of third-party rights

• Misuse of third-party integrations

18. Governing Law

These Terms shall be governed by the laws applicable in India.

Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts having jurisdiction over TapNow India's applicable place of business.

19. Changes to Terms

TapNow India may update these Terms from time to time. Continued use of the services after updated Terms are published constitutes acceptance of the revised Terms, subject to applicable law.
